The purpose of these General Conditions is to regulate the conditions of use and contracting of the website “http://www.tiendajulianmartin.es/” (hereinafter “the website”), whose owner is JULIAN MARTIN S.A.. (hereinafter, JULIAN MARTIN), with CIF A37051448.

In no case shall access to them or their use by the User imply any kind of waiver, transfer or total or partial transfer of such rights, or confer any right of use, alteration, exploitation, reproduction, distribution or public communication of such content without the prior and express authorisation specifically granted for that purpose by JULIAN MARTIN or the third party owner of the rights affected.

All trademarks, trade names or logos displayed on this page are the property of JULIAN MARTIN and/or third party companies. It is forbidden to use them or permanently download, copy or distribute them by any means without the mandatory consent of their owner.

In the event that any User or third party considers that any of the contents has been introduced on the website in violation of their Intellectual or Industrial Property rights, they must send a notification to JULIAN MARTIN identifying themselves and, where appropriate, the holder of the intellectual or industrial property rights allegedly infringed, providing title or accreditation of the representation of the aforementioned rights.

JULIAN MARTIN informs you, in accordance with the provisions of Law 15/1999 on the Protection of Personal Data, that the personal data provided through the registration form on the website will be incorporated into an automated file in order to manage the services offered by the website to registered users and process purchases made, as well as to send commercial communications about our product offerings by various means, including electronic. 6.1 Purchase procedure. 
To make the first purchase of the products offered on the website, you can become a registered user of the same, through the form provided for the purpose. On subsequent occasions, it will be sufficient to identify yourself as a registered user to proceed with the purchase. The processing of the personal data provided will be in accordance with the provisions of clause 5 of these General Conditions, and the User undertakes to provide this information truthfully and completely. The data may be modified by the registered user at any time through the “my account” section of the website.

To complete the purchase, the User must add the desired products to their shopping basket and click on the “checkout” button when their order is complete. Then you can indicate your shipping address and, where appropriate, the method of payment and shipping.

JULIAN MARTIN reserves the right to modify the commercial offer presented on the website (regarding products, prices, promotions and other conditions) at any time.

JULIAN MARTIN will make every effort within its means to offer the information contained on the website truthfully and without typographical errors. In the event that at any time there is an error of this type, it will be corrected immediately. If, there is a typographical error in any of the information relating to our products, a customer has made a purchase decision based on that error, JULIAN MARTIN will inform the customer of the error, with the customer having the option to cancel the purchase without any cost on their part or adhere to the conditions and / or price again communicated. The photographs shown of the products are merely indicative, and there may be non-significant variations with respect to the actual appearance of the product.

6.2. Prices and method of payment. 
The prices of the products offered on the website include Value Added Tax (VAT).
The products purchased must be paid by bank card or via PayPal, with secure data transmission.

6.3. Shipping method and cost. 
JULIAN MARTIN sends orders to its customers through express transport companies of recognized solvency. The date of delivery to the User’s home will depend on the availability of the chosen product and the shipping area. Under normal conditions, and unless otherwise indicated by JULIAN MARTIN, the delivery time will be 3/4 days for Spain (peninsula).
Transport 9,80 Euros per shipment, regardless of the weight of the shipment (Peninsula except Balearic Islands, Canary Islands, Ceuta and Melilla).

6.4. Right of withdrawal. 
In accordance with the provisions of Law 7/1996, on the Regulation of Retail Trade, the buyer has a period of 7 working days, counted from receipt of the product, to withdraw from the contract without the need to indicate the reasons. It is an essential requirement that both the packaging and the product are in perfect condition, have not been tampered with, do not present defects or deterioration due to external events or other circumstances that result in the impairment of the product, especially the opening of the container. The returned order must be delivered together with the delivery note and, where appropriate, the invoice issued to JULIAN MARTIN.
To exercise your right of withdrawal, the Customer must contact JULIAN MARTIN, through the address tienda@julianmartin.es. In the event that the return proceeds, JULIAN MARTIN will indicate the procedure for the same and after verifying that the good has not suffered damage and meets the conditions described in the preceding paragraph, will make the refund of the amount paid for the product, by the same means by which the payment was made. The costs derived from the return shall be borne by the buyer, as established in Law 7/1996.

7. Confidentiality. 
All information that either party communicates or provides to the other or to which either party has access will be considered confidential and may not be disclosed, shown, reproduced, copied, discussed with third parties, or used by either party for purposes other than those for which it was communicated.

8. Applicable law and jurisdiction. 
These General Conditions shall be governed by the provisions of Spanish law. For any questions that may arise between the parties in relation to the interpretation and execution of this document, both parties expressly agree to the jurisdiction of the Courts and Tribunals of Salamanca, renouncing any other jurisdiction that may correspond to them.
